Terms and Conditions
By making payment you are agreeing to the following terms & conditions;
1. DEFINITIONS
(a) The “Owner” is Bluebird Picnic Co., LLC
(b) The “Client” refers to the person, firm or corporation booking an event or hiring equipment from the Owner.
(c) The “Equipment” means all the equipment and accessories supplied to the client.
(d) “Terms” means these Terms and Conditions.
(e) “Booking” refers to the goods or services agreed between the Owner and Client.
2. CONDITIONS OF BOOKING & RENTAL
(a) The renting of the equipment will commence from the commencement date specified on your invoice and continue for the term specified. The client is entitled to use the equipment for the rental period. Any extension of the period must be agreed to by Bluebird Picnic Co., or additional fees will be incurred.
(b) The client acknowledges responsibility for the equipment and is liable for any damage.
3. PAYMENT
(a) Payments for picnic services can be made via major credit card, processed by Square.
(b) Payment is due in full at the time of booking.
(b) Bluebird Picnic Co, has authorization to keep the Client’s credit card on file for any future transactions until a cancellation is requested. Terms of this authorization will remain in effect until the Client requests, in writing, that they be terminated.
(b) Credit card security details must be provided at the time of booking. An order will not be confirmed until and unless credit card security details are endorsed and supplied to the Owner. No payment will be taken from the given credit card unless damage is made to items or they are not returned.
4. CANCELLATION AND REFUND POLICY
(a) Requests to cancel must be in writing to bluebirdpicnicco@gmail.com. A Client will receive a full refund monies paid if the picnic cancellation request is received more than 7 days in advance. Cancellations received 7 or fewer days prior to the picnic, are not eligible for refunds.
(b) Up to two (2) inclement weather postponements may occur. The Owner will keep any payments for the picnic package, and apply them to the mutually agreed upon rescheduled date(s).
(c) If Bluebird Picnic Company must cancel due to illness, injury, or unforseen circumstances, the client may choose to reschedule or have a full refund.
(d) Bluebird Picnic Company has the right to postpone/reschedule picnics when weather conditions pose a risk to employees, clients or equipment. Such conditions include any rain, wildfire smoke, winds in excess of 10mph and temperatures of more than 90 degrees.
4. DELIVERY & COLLECTION
(a) The equipment shall be returned in a reasonably clean, but not necessarily sterile state.
(b) The Client must allow any Bluebird Picnic Co. representative access to the goods/equipment at all reasonable times.
(c) The Client must provide safe and proper access to and at the event site.
5. DAMAGE
(a) The Client is responsible for the equipment from the time of delivery until collected by the Owner and the Client shall pay for all equipment damage or loss however caused during that period. Damage waiver is payable by the Client to cover all costs associated with normal wear and tear to the equipment rented, the waiver does not apply to any other damage including:
(i) damage resulting from overloading, exceeding rated capacity, misuse, abuse or improper servicing of equipment;
(ii) Damage due to mysterious disappearance of the equipment;
(iii) Damage caused by the use or operation of equipment in contravention of any of the conditions of the agreement;
(iv) Damage to, or loss of, the equipment from any unknown cause.
(v) Candle wax burns on any furniture or decor items.
(vi) Red wine spillages or stains on any furniture or decor items.
(vii) Evidence of smoking of cigarettes or any substance around the rented equipment will incur a $250 cleaning fee.
(b) The Client shall protect the equipment from the elements during the time of delivery, use, storage or waiting period before pick-up.
(c) The Client shall maintain at its expense liability, property and casualty insurance coverage in amount necessary to fully protect the Owner and its equipment against all claims, loss or damage of whatever nature or type.
(d) The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the equipment hereby rented and the Client indemnifies the Owner in respect to any claims for such loss or damage.
(e) Any person signing the documents for and on behalf of the Client hereby covenants with the Owner that he or she has the authority of the Client to make this agreement on the Client’s behalf and is empowered by the Client to bind the Client to this agreement and hereby indemnifies the Owner against all losses and cost incurred by the Owner arising out of the person signing this agreement failing to have such power and/or authority.
(f) Where the Client is more than one person liability shall be joint.
(g) By making a booking through confirming a quote via signature, deposit payment or remittance of funds, the client acknowledges and agrees to the Owners Terms and Conditions.
6. LATE POLICY & NO SHOW
(a) A surcharge fee will be charged to your nominated credit card if late. 0-10 mins no charge, 15 mins or part thereof $20, 30 mins or part thereof $50, 45 mins or part thereof $80, an hour or more $100, and the Owner will have the right to pack up the picnic without any refund.
(b) A surcharge fee of $100 will be charged to your nominated credit card if Client leaves the picnic unattended and before the Owner returns to pack up.
(c) Client is liable for full cost of picnic rentals depending on any stolen/missing items
In the case of one of these occurring, Bluebird Picnic Co. will advise you and charge the amount from the above credit card within 15 working days from the date of the booking.

(a) Bluebird Picnic Co., LLC’s web and print content is protected by copyright laws
(b) Content on our site can’t be used for commercial purposes by others
US Federal laws govern the use of this site in the event of a dispute
